Contract Law

ASSIGNMENT – You are required to write an essay providing advice to Mr and Mrs Marshall, using your current knowledge of contract law, about: a) whether they can sue ALML for breach of contract. Whether ALML has grounds to demand payment. Although you are asked to provide advice, your answer should be in an essay format, not a letter or a report. The essay will have two sections, part a (advice on whether the Marshalls can sue for breach of contract) and part b (advice on grounds for payment). Each section should present a reasoned, supported, argument and conclusion for the relevant part of the task. You can allocate your word count between part a and part b as you wish but should not exceed the total word count.

You should consider, and analyze, the scenario above, the detail provided in the animation (Appendix 1) and the two letters mentioned (Appendix 2) to help you write your essay. Your advice should be legal, not practical (i.e do not recommend that the Marshalls consult a solicitor). You do not need to explain your choice of scenario in the essay. You are provided with a guide on PLAC method if needed. Below are a few guidelines to help with this assignment;. Firstly, make sure that you are sticking to the laws of England and Wales when you are providing supporting authority. Go back to the VLE materials and look at the case law provided there.

Using the correct authority will help your mark for criterion 3, you could easily gain 2 marks here, and 4 with a little more effort. Secondly, proof read out the repetition and any irrelevant material. This could lift your mark for criterion 1 to 6/7 quite easily. Thirdly, make sure that you set out all the essential elements for a contract. Don’t start by talking about breach, start by talking about formation… This would lift your mark by up to three marks. Read carefully the ‘expected elements’ section of the feedback summary – that might help.
