This paper explores arbitration provision in click-through agreement. Discussion: For those of us who are Uber users, we’ve all agreed to their “Terms of Use” by virtue of clicking “I accept” and creating an account. This type of contract is known as a “click-through” agreement.

Discussion: For those of us who are Uber users, we’ve all agreed to their “Terms of Use” by virtue of clicking “I accept” and creating an account. This type of contract is known as a “click-through” agreement. Even though the terms of a click-through agreement can be accepted without reading the agreement and even though users have no opportunity to negotiate the terms, this type of agreement has been upheld by courts in many instances. Thus, these are terms that we should be familiar with as users.
