Criminal Trial Paper details: The Sixth Amendment and various statutory provisions provide numerous procedural protections to those accused of crimes. Statutes of limitations provide pre accusation protections by requiring that prosecutions commence within a specified period of time from the date of the alleged commission of the offense. Due process also provides pre accusation even if an indictment is brought within the prescribed statute of limitations if the government unreasonably delayed prosecution either to harass a defendant or to gain a tactical advantage for itself in a manner which causes actual prejudice to the defendant.
